Medical malpractice premiums actually dropped in 2008 and were forecast to decline further throughout 2009, according to the Physician Insurers Association of America. Is the decline related to state laws that cap malpractice claims? No, studies show that such caps do not result in lower premiums. Instead, the drop is attributable to effective risk-mitigation techniques. For example, anesthesiologists have kept premiums steady by using devices that alert them to potentially fatal problems in the operating room. The result: Less fatalities and lower premiums.
